Death By Firing Squad For Violent Rapists of Children Under 12 (Will the CIA Be Prosecuted?)

In late March 2025, Brad Little signed House Bill 380, making Idaho the first state in modern times to authorize the death penalty for certain non-homicide crimes involving the sexual abuse of children under 12. The law, which took effect July 1, 2025, allows prosecutors to pursue capital punishment if specific aggravating factors are present, such as multiple offenses or the use of force.
The legislation coincides with Idaho’s move to make the firing squad its primary method of execution under House Bill 37, with full implementation scheduled for July 1, 2026. The state has reportedly allocated funding for facility renovations to accommodate a mechanized or remote-operated system.
Legal analysts widely expect constitutional challenges, particularly referencing the U.S. Supreme Court’s 2008 ruling in Kennedy v. Louisiana, which held that the death penalty for child rape where the victim did not die violates the Eighth Amendment’s prohibition on cruel and unusual punishment. Some Idaho lawmakers argue the current Court could revisit that precedent, while others believe the ruling remains firmly established.
Supporters of the law, including Raúl Labrador, argue that the severity and long-term harm of such crimes justify the harshest penalties. Critics counter that expanding capital punishment in non-homicide cases could create unintended consequences, including discouraging victims from reporting abuse, especially when the accused is a family member.
Similar legislation has been passed in states such as Florida and Tennessee, signaling a broader national debate over deterrence, constitutional limits, and evolving standards under the Eighth Amendment.
The issue now appears headed toward judicial review, placing Idaho at the center of a renewed national conversation about justice, retribution, and constitutional interpretation.
