Nominee to Serve as an Associate Justice on the Supreme Court of the United States
On July 9, 2018, President Donald J. Trump announced his intention to nominate Judge Brett M. Kavanaugh to serve as an Associate Justice on the Supreme Court of the United States following the retirement of Justice Anthony Kennedy.
The Constitution gives the Senate the power of “advice and consent” with respect to all judicial nominees. To fulfill this constitutional duty, the Senate Judiciary Committee will evaluate Judge Kavanaugh’s background and qualifications for the high court. The committee will thoroughly examine Judge Kavanaugh’s record from his time as a judge on the U.S. Circuit Court of Appeals for the D.C. Circuit and from his service as a lawyer for the government, as well as his general background. The committee will also hold a hearing during which members of the committee will be able to question the nominee and hear from other outside witnesses.
Nomination Materials
On July 21, 2018, Judge Kavanaugh submitted 120 pages of written answers and more than 17,000 pages of material in response to the Senate Judiciary Questionnaire, the most comprehensive questionnaire ever submitted to a Supreme Court nominee. The Committee has also requested that the National Archives produce presidential records from Judge Kavanaugh’s service as an Executive Branch lawyer, including his service in the White House Counsel’s Office and his service for Independent Counsel Kenneth Starr. The Archives has begun an expedited review of those records for release to the Committee and the public. President George W. Bush is also providing records on an expedited basis to assist in the review. The committee will review these and other records as it evaluates the nominee.

Nominations Hearing
Chairman Grassley has scheduled a hearing for the week of September 4, 2018. The hearing, which is expected to last three to four days, is an opportunity for senators and the public to hear directly from the nominee as well as other legal experts and those who know Judge Kavanaugh best.
