In American psychiatry, prior to the publication of the DSM-I, paraphilias were classified as cases of “psychopathic personality with pathologic sexuality”. The DSM-I (1952) included sexual deviation as a personality disorder of sociopathic subtype. The only diagnostic guidance was that sexual deviation should have been “reserved for deviant sexuality which [was] not symptomatic of more extensive syndromes, such as schizophrenic or obsessional reactions”. The specifics of the disorder were to be provided by the clinician as a “supplementary term” to the sexual deviation diagnosis; there were no restrictions in the DSM-I on what this supplementary term could be.^[39] Researcher Anil Aggrawal writes that the now-obsolete DSM-I listed examples of supplementary terms for pathological behavior to include “homosexuality, transvestism, pedophilia, fetishism, and sexual sadism, including rape, sexual assault, mutilation.”^[40]

In April 2019, Women Are Human reported that a flurry of male inmates were demanding access to women’s prisons in the state of Illinois, and two had already succeeded in obtaining the requested transfers. Now one of those two men stands accused of the rape of a female inmate, who says prison officials covered up the crime. On April 1 of last year, 29-year-old Janiah Monroe was transferred from Pontiac Correctional Center, a prison for men, to women’s prison Logan Correctional Center after the MacArthur Justice Center and the Uptown People’s Law Center (UPLC) filed a lawsuit against the Illinois Department of Corrections (IDOC) on his behalf. Inmate Janiah Monroe (né Andre Patterson), who killed his cellmate with his bare hands during an argument, was moved to a women’s prison after claiming other men “sexual harassed” him over the decade he spent in men’s prison, causing him to feel unsafe. Two months after the move, he was accused of raping a female inmate. (Credit: Illinois Department of Corrections) Named Andre Patterson before he began identifying as a woman, Mr Monroe’s extensive criminal record includes convictions for second-degree murder, attempted murder, aggravated battery and attempted aggravated arson. He is currently serving time for 11 felonies. At age 17, Mr Monroe had an argument with his male jail cellmate, 31-year-old Kimani Muhammad, and strangled him to death. At the time of the homicide, Mr Monroe was being held on suspicion of aggravated battery with a firearm after shooting two people outside a barber shop. Two months after the transfer to Logan, Mr Monroe, who still has intact male genitalia, was placed in a cell with a woman whom he immediately began “express[ing] an interest” in. According to the lawsuit, the woman was terrified of Mr Monroe due to his much greater size and strength. Mr Monroe overpowered and raped her that day, she said. Following the incident, the woman was moved into the prison’s Health Care Unit and interviewed by internal affairs officers. Todd Sexton, a supervisory officer, told the woman he did not believe her and coerced her into providing a statement in which she retracted the rape allegation, she said. She was then subjected to months of punishment by the IDOC for filing a false complaint under the Prison Rape Elimination Act (PREA). The victim has filed a federal lawsuit against several prison employees, including officers Mr Sexton and Brent Keeler and warden Beatrice Calhoun. The IDOC attempted to return Mr Monroe to Pontiac shortly after the purported rape. However, just as he was being escorted by van from the gates of Logan, the governor’s office intervened, and US District Court Judge Michael Mihm issued an injunction barring the return of Mr Monroe to the men’s facility, where Mr Monroe claims he had been subjected to “sexual harassment” over the course of 10 years of imprisonment. The terms of the injunction require the IDOC to issue an explanation for why it is necessary to transfer Mr Monroe back to men’s prison, and to provide 14 days’ notice to the court and to Mr Monroe’s lawyer before executing any transfer. Alan Mills, Legal Director of the UPLC, which had successfully represented Mr Monroe and Deon “Strawberry” Hampton in their bids to be transferred into women’s prison, confirmed that Mr Monroe is the accused rapist. “Our understanding is the Department of Corrections investigated this incident and found that it was consensual sex, not rape,” Mr Mills insisted. Mr Monroe has expressed exclusive sexual interest in men, but Mr Mills said it is common for prison behavior to not match sexual orientation. He acknowledged that his client has been the subject of accusations of sexual harassment from several women at the prison, but argued that “transphobia exists everywhere, both out here on the street and in prison, so it’s not surprising that there are some people who feel uncomfortable with [Janiah’s] presence in a women’s prison.” Alan Mills, Legal Director of Uptown People’s Law Center, represented murderer Janiah Monroe in his successful bid to move to women’s prison. (Credit: Charlie Simokaitis) Glen Austin, who was warden of Logan when Mr Monroe first arrived, said in his July deposition, “I don’t think that [Monroe’s] transitioning to Logan has been successful.” He noted that the inmate has accrued “multiple tickets, serious infractions, previous PREA allegations, inappropriate sexual behavior and a confirmed investigation that substantiated sexual misconduct” at Logan. “Her actions here at the facility … with her history, to me it is very concerning,” Mr Austin said. Mr Monroe has threatened violence against staff and inmates, according to Dr William Puga, Chief of Psychiatry for the IDOC, and stopped taking feminizing hormones since placement at Logan. Mr Mills denied that his client has ceased the hormones, and said his client has requested gender-affirming surgery. Mr Monroe, who is expected to be released in 2051, has attempted suicide while at Logan, and has a history of attempted castration and mutilation of his own genitalia, his lawyer said. A notorious rapist and triple murderer, serving six consecutive life sentences for participating in a deadly home invasion in which a woman and her daughters were raped and tortured, has now revealed that he identifies as a woman and plans to transition. The violent convict is complaining about his treatment in men’s prison while presenting “as female,” thereby paving the way for a possible transfer to women’s prison. In July 2007, Steven Hayes, aged 56, and accomplice Joshua Komisarjevsky, broke into the upscale home of the Petit family in Cheshire, Connecticut. Dr William Petit was the sole survivor of the massacre that claimed the lives of his wife Jennifer, a nurse, and the couple’s two daughters, Hayley and Michaela. The pair beat Dr William Petit in the head with a baseball bat, and left the severely injured man bound in the basement. The men stole $103 from the wallet of 17-year-old Hayley, and held the family captive until morning when the bank opened. One of the men then drove Jennifer Hawke-Petit to the bank to withdraw cash. Ms Hawke-Petit calmly informed the bank teller that her family was being held hostage and would be murdered if the kidnappers didn’t receive $15,000. The teller gave Ms Hawke-Petit that sum, which was more than she had in her bank account, and called the police once she left. Back at the home, the men raped Ms Hawke-Petit, and sodomized her 11-year-old daughter, Michaela. A naked Mr Komisarjevsky posed suggestively with the bound girl in seven photos taken on his cell phone. An eighth photo depicted Ms Hawke-Petit with her legs spread. When Mr Hayes saw police cruisers pull up outside the home, he panicked and strangled Ms Hawke-Petit to death. He doused the girls with gasoline, and the men set the house on fire. Left bound to their beds, the girls succumbed to smoke inhalation. The suspects were apprehended when they crashed their car into a police barricade while attempting to flee. Dr Petit managed to escape the massacre, rolling onto the neighbor’s property to seek help just as his house burst into flames behind him. The fire was too ferocious to allow rescue of the remaining inhabitants, Paul Makuc of the state fire marshal’s office would later say. The Petit family home was destroyed by the killers. “What was a vibrant house of people at 9 o’clock became a house of terror and horror,” State’s Attorney Michael Dearington told jurors during the trial. “There’s no way to recreate the fear, the terror, the horror that those girls experienced in their last few minutes.” Mr Hayes and Mr Komisarjevsky were sentenced to death. In 2016, their sentences were commuted to life with no chance of parole after the Supreme Court of Connecticut ruled the death penalty unconstitutional. He began wearing a yarmulke, and in 2014, sued the state for violating his First Amendment right to free exercise of religion and Eighth Amendment right against cruel and unusual punishment by denying him kosher food. He sought an injunction ordering the Department of Corrections to provide pre-packaged kosher meals to all Jewish inmates in Connecticut prisons, and demanded $15,000 in punitive and compensatory damages for “intentional infliction of pain, suffering and resulting weight loss from the deliberate denial of a kosher diet.” US District Court Judge Alvin Thompson ruled against the inmate, finding that Mr Hayes’s meals, which are certified by two rabbis who monitor the preparation of kosher food in the state’s prison system, was sufficient to meet kosher standards. On October 12, 2019, Mr Hayes told Joe Tomaso, host of the podcast “15 Minutes With…,” that he is transgender and currently receiving hormones. He has altered his prison gear to look feminine, he said. “I am a transgender. I was diagnosed at 16 with sexual identity disorder and my family never acknowledged it and it was never treated,” Mr Hayes said. “There’s a lot of problems with the presentation as a female. I mean a lot people accept it, but this facility here, you have a lot of racist and bigot staff and they’re not happy.” Pennsylvania Department of Corrections spokeswoman Maria Finn revealed that Connecticut pays $60,600 a year total for gender-affirming surgeries and hormones for the 222 state prisoners who identify as transgender.
